Assembly Bill 2904 (AB 2904), authored by Assemblymember Quirk-Silva and effective as of January 1, 2025, amends Government Code Section 65854 to modify the notice requirements for public hearings concerning proposed zoning ordinances and amendments that affects the permitted uses of real property. The bill extends the minimum notice period from ten (10) days to twenty (20) days.
Although AB 2904 does not define what types of zone changes would affect permitted uses of real property, it likely includes, but would not be limited to:
- Rezoning
- The addition/modification/removal of permitted, conditional, and prohibited uses
- Location, height, bulk, number of stories, and size of buildings and structures.
- The size and use of lots, yards, courts, and other open spaces.
- The percentage of a lot which may be occupied by a building or structure.
- The intensity of land use.
- Requirements for offstreet parking and loading.
- Building setback lines
Zoning ordinances or amendments involving only administrative provisions would not be subject to AB 2904’s extended notice requirement. AB 2904 applies to all municipalities, including charter cities. Local governments should review and revise their public notice procedures accordingly to ensure compliance with the new statutory mandate.
